Massachusetts Family Law FAQ

How long does a divorce take in Massachusetts?
An uncontested divorce (1A) where both parties agree on all terms typically takes 90–120 days after filing. A contested divorce (1B) can take anywhere from 6 months to over 2 years depending on the complexity of issues like custody, property division, and support. Attorney Gaudet works to resolve matters efficiently while protecting your interests.
How is child custody determined in Massachusetts?
Massachusetts courts determine custody based on the “best interests of the child” standard. Factors include each parent’s relationship with the child, the child’s adjustment to home and school, and the ability of each parent to meet the child’s needs. Both physical custody (where the child lives) and legal custody (decision-making rights) are addressed.
Is Massachusetts a 50/50 property division state?
Massachusetts follows an “equitable distribution” model, meaning marital property is divided fairly — but not necessarily equally. The court considers the length of the marriage, each spouse’s contributions, economic circumstances, and other factors. Attorney Gaudet can help you understand what a fair outcome looks like in your specific situation.
Can I modify a custody or support order later?
Yes. Massachusetts law allows modifications when there has been a material change in circumstances — such as a significant change in income, relocation, or a child’s changing needs. Attorney Gaudet can file a Complaint for Modification on your behalf and represent you in the modification hearing.
Do I need an attorney for an uncontested divorce?
You are not legally required to have an attorney, but having one helps ensure your separation agreement is complete, legally sound, and truly protects your interests. Many clients believe they agree on everything — only to discover complications once they start drafting the legal paperwork. A consultation with Attorney Gaudet costs far less than fixing a flawed agreement later.
