Working in the U.S. under the H-1B Visa for Health Care and Other Workers

H-1B Visa

Whether your profession is that of a nurse, physician, certain types of medical technician, pharmacist, or other health care professional, you may be eligible to work in the U.S. under the H-1B Visa.

H-1 B Visa Requirements

To work under the H-1B Visa in the United States, there are certain minimum requirements that must be met by the prospective Visa applicant. First, the applicant must have both theoretical and practical knowledge in a specialized field, and must possess a bachelor’s degree or higher degree in that area (or equivalent field of study). Next, a bachelor’s or higher degree must be the minimum requirement for entry level in the particular job in question, or certain other considerations must be met. Also, the applicant for the H-1B Visa must file a Form ETA-9035/9035E, also known as a Labor Condition Application (LCA) and Form I-129, the Petition for Nonimmigrant Worker.

Specific Requirements for Your Degree

Not only must one have a bachelor’s degree or higher in the field in which you are seeking work in the United States, but that degree must meet further specific requirements to be considered an eligible degree by immigration officials. The degree must be a U.S. degree from an accredited college or university, a foreign degree equivalent to a U.S. degree of the same kind, or you must possess an unrestricted state license or certification that gives you the authority to practice in the field in question.

If you hold a bachelor’s degree or higher from an accredited U.S. college or university, or a foreign degree equivalent to that of a U.S. college or university, or hold an unrestricted license, registration, or certification in the state in which you wish to practice, or have specialized training, education, or experience in that specialty equivalent to that which would be achieved with a U.S. degree in that field, you may be eligible for the H-1B2 Visa. Visa holders wishing to work in the U.S. under the H-1B Visa must have significant research or development project experience in their respective fields.

If you are a fashion model well known in your industry, having received accomplishments based upon your merit and ability, you may be eligible to work in the United States under the H-1B3 Fashion Model Visa.
